I actually read this a few days ago while at ACEP and couldn't post it until now but it looks like many agree with my assessment. Since the initial article the officer dropped the suit and has now been fired.

If you're responding to a meth lab or arson or a drunk fine but a kid in a near drowning and you say the grandparents were negligent for not mopping up after they dragged junior's blue corpse out of the pool? Holy crap. I can't figure out who's dumber, the cop or the lawyer. Maybe it's the two of them together that resulted in such a black hole of ultra dense stupidity.

The officer who had actually been on suspension has now been officially fired.

Unbelievable... Like those people need anything else on their mind with a 1 yr old in a nursing home. Thats heart wrenching to know that the are going to see their grandson in a nursing home rather than the other way around. That Officer is sick. Glad to see justice served though against the cop.
