This is from the National Defense Authorization Act for Fiscal Year 2008.


SEC. 616. INCREASE IN DENTAL OFFICER ADDITIONAL SPECIAL PAY.

Section 302b(a)(4) of title 37, United States Code, is amended--

(1) by striking `at the following rates' in the matter preceding subparagraph (A) and inserting `at a rate determined by the Secretary concerned, not to exceed';

(2) in subparagraph (A), by striking `$4,000' and inserting `$10,000'; and

(3) in subparagraph (B), by striking `$6,000' and inserting `$12,000'.

what is the difference between subparagraph A and B? Do you have a link to this? I'm too lazy to try to find it.

Here you go. This will bring you to section 302b. You'll still have to scroll down to part 4 of section A to see what it was originally. 2008's change proposes to change from 4 to 10K.
 
Why would they change the wording from "shall be paid at the following rates" to "shall not exceed the following"? Obviously the wording change is for some reason. The only one I can think of is that when worded like this the special pay can now be denied completely. Before, it had to be paid be law. Now it simply should not exceed a certain amount. Zero certainly doesn't exceed the amount and thus becomes lawful.
