change in sp/pic form in new ownership (ny)

Hey guys,

Is it necessary to fill out the change in sp form in ny (http://www.op.nysed.gov/prof/pharm/pharm-ph205.pdf) if the store was bought out? I know you have to do that with an existing establishment but the new owner is saying it's not necessary if the store is under new ownership and new business name (even though the DBA stayed the same)

I am a little concerned because i have been there for almost 2 months and the change in sp form should be submitted within 7 days. i signed all the papers and i was under the impression that it was already submitted.

Is it under a new pharmacy license #?

yes i believe so. new dea, new license etc
If it has a new license, it’s a new pharmacy. The PIC should have been declared during that process. It wouldn’t make sense to have the PIC “change” in that scenario.
